1. Acceptance of Terms

By accessing or using the Northstar Email Platform (the "Service") operated by Northstar College Recruiting ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

The Northstar Email Platform is a college athletic recruiting tool that enables student-athletes to compose, personalize, and send emails to college coaches. The Service integrates with third-party email providers (Gmail, Outlook) to send emails on your behalf.

3. Account Registration

  • You must be invited by an authorized administrator to create an account
  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 13 years old to use the Service
  • You are responsible for all activity that occurs under your account

4. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited bulk email, or harassing messages
  • Impersonate any person or misrepresent your identity or affiliation
  • Send content that is illegal, threatening, abusive, or defamatory
  • Violate any applicable laws or regulations, including CAN-SPAM or similar email regulations
  • Attempt to gain unauthorized access to other users' accounts or data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any purpose other than legitimate college recruiting communication

5. Email Sending

  • Emails are sent from your connected email account (Gmail or Outlook)
  • You are solely responsible for the content of emails you send through the Service
  • We may impose rate limits on email sending to prevent abuse
  • You must comply with all applicable email laws and regulations
  • We reserve the right to suspend accounts that violate email sending policies

6. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Northstar College Recruiting and protected by intellectual property laws. You retain ownership of content you create (templates, personalizations, etc.) but grant us a license to use it to provide the Service.

7. Third-Party Integrations

The Service integrates with third-party email providers. Your use of these integrations is subject to the respective provider's terms of service:

  • Google's Terms of Service and API Services User Data Policy
  • Microsoft's Terms of Use and Services Agreement

We are not responsible for any changes, outages, or issues with third-party services.

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may request account deletion at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE EMAIL DELIVERY OR THAT EMAILS WILL NOT BE FLAGGED AS SPAM BY RECIPIENTS' EMAIL PROVIDERS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NORTHSTAR COLLEGE RECRUITING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Northstar College Recruiting from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
